This agreement is an effective agreement concluded by China Mobile IOT Co., Ltd. OneNET opening platform (hereinafter referred to as OneNET) and you about relevant matters of IMEI complaint service. You can click the page to confirm the agreement or choose to accept this service agreement in other ways, including, but not limited to your use of IMEI complaint service, although you haven’t confirmed the service agreement; your use of IMEI complaint service means you have reached an agreement with China Mobile IOT, and you have accepted all contents of this statement. Before accepting this statement, please carefully read all contents of this statement. If you have any doubts of the clauses of this statement, please consult OneNET through relevant channels. OneNET will explain the clauses to you. If you disagree with any contents of this statement, or you can’t precisely understand China Mobile IOT’s explanation of the statement, please do not continue with operations.
The complaining party submits the real IMEI complaint information to OneNET platform, including IMEI, module model, module picture, contact information, detailed description etc. After OneNET platform receives the complaint, it will have an understanding of the state of the compaining party and the current user and take further actions. The processing method includes:
1.1 Instance 1: When the user ID of the complainant on OneNET is the same as the user ID of the user on OneNET, OneNET has the right to directly refuse the complaint, and can notify the complainant to delete it through the system;
1.2 Instance 2: When the user ID of the complainant on OneNET is different from the user ID of the user on OneNET, OneNET personnel will contact and coordinate with both parties; if both parties clearly confirm that the module belongs to the complainant, OneNET personnel will contact the user and assist in deleting it, but it will not guarantee the time-effectiveness; or, when agreed by both parties, the user can submit a written application asking OneNET personnel to delete it on behalf, and notify it through the system;
1.3 Instance 3: When the user ID of the complainant on OneNET is different from the user ID of the user on OneNET, OneNET personnel will contact and coordinate with both parties; if the complainant and user can’t reach an agreement about the ownership of the module, the platform will not determine the ownership and will not delete any information. Under such circumstance, both parties are suggested to confirm the ownership of the module and IMEI No. through legal ways and submit relevant certificate with a legal effect to OneNET in writing, so that OneNET can take further actions; 1.4 Instance 4: When the complainant submits a complaint, if after verification, OneNET confirms it’s the problem of the module supplier that makes IMEI unusable on OneNET, the complainant shall feed back to the module supplier, and the platform can provide desensitized information to assist the complainant;
2.1 You agree to comply with this service agreement as well as relevant management norms and procedures for the service display page, and understand that the above agreement and norms may be changed owing to the distinctiveness of the platform service.
2.2 The complaint submitted by you to OneNET is true, and OneNET and the third party review organ entrusted by OneNET are irrevocably authorized to verify and check the materials submitted. You understand and agree that the release of information, maintenance of contents, and operation management for making a complaint shall comply with the state laws and regulations, polies, and relevant requirements of the Service Clauses of OneNET IOT Opening Platform. If you act in violation of the above commitments, you will bear relevant liabilities.
3.1 OneNET only provides assistance in dealing with the IMEI complaint and does not promise to properly deal with all complaints submitted. For the complaints about the following, the platform has the right to refuse to provide any assistance:
3.1.1 The complaint information or evidentiary materials submitted by you are incomplete.
3.1.2 You have provided false complaint information.
3.1.3 During mediation, the complainant and user have different opinions about the module ownership and can’t reach a consensus.
3.1.4 Either the complainant or the user is unwilling to delete IMEI.
3.2 China Mobile IoT shall strictly observe secrecy.
4.1 China Mobile IOT Co., Ltd. possesses the final right to interpret this agreement.
4.2 This agreement will take effect once it’s promulgated. Considering the uncertainty in the platform service, OneNET has the right to make revisions to the content at any time, and the revised agreement will be publicized on the official website of OneNET. If you disagree with the revisions made by OneNET to relevant clauses of this agreement, you have the right to stop using this service. If you continue using this service, you are considered to have accepted the revisions made by OneNET to relevant clauses of this agreement.
4.3 If any clauses of this agreement are completely or partially invalid or inexecutable owing to any reasons, the remaining clauses of this agreement shall still remain valid and binding.
